Holmes and Balwani’s appeal falls flat as court upholds fraud convictions

Elizabeth Holmes and Ramesh “Sunny” Balwani’s complaints to cancel their dedications for fraud and reduce their prison penalties were rejected Monday, by the California Court in the North District, which also refused to soften its common order to refund in the amount of $ 452 million.

Holmes, founder Theranos, and Balwani, his former Coo, were convicted in separate trials in 2022 For the fraud of investors on the capabilities of Tehanos’s blood testing technology. Holmes was sentenced to more than 11 years in prison and Balwani was granted almost 13 years. They both began to support their sentences in 2023.

In their appeal, the two claimed that the district court allowed the improper testimony of former Theranos employees who served as lay witnesses, but ended up offering improper testimony without the necessary legal appointment. The appeal council agreed that some testimony had moved to the expert territory, but concluded that the mistakes were harmless.

Holmes also challenged the involvement of the damn Government report This emphasized the failures in the Laboratory of Theranos, claiming that it had an unjust affect the jury. But the court found that the report was relevant to the establishment of her knowledge and intention. Holmes claimed that her rights were violated when she was forbidden to cross the former Laboratory director Theranos, regarding the aspects of his employment after Teran. Again, the appeal council did not agree, saying that the court did not “abuse his discretionary right in limiting the extent of the cross -examination.”

In the meantime, Balwani claimed that his accusations were improperly expanded during the trial (the Council rejected this argument quite greatly). He also claimed that his right to a fair trial had been violated because the government did not correct what she said was a false testimony of two investors. The court also rejected that argument, saying that even if there were problems, they would not affect the outcome of the case.

Balwani serves his punishment in a gloomy named Terminal Island, a federal minimum security facility, just beyond Los Angeles; Holmes serves at the Bryan camp, a minimum federal prison camp of security that is about 100 miles away from Houston.
